How USA ROCK works

USA ROCK is an online materials marketplace where customers shop for bulk landscaping and construction materials. We sell the ordered load and coordinate fulfillment through independent material suppliers and delivery providers. USA ROCK is not a manufacturer or trucking company.

This policy applies to USA ROCK deliveries at every United States location we agree to serve. A nationwide policy is not a promise that delivery is available in every state, city or ZIP code; material availability and delivery to your exact address require confirmation.

Material appearance and photos

Bulk materials may vary in color, size, shape, texture and structure depending on the source, supplier and delivery location. Natural variations can occur between loads of the same material.

Product photos are for reference only. They show a general example and do not guarantee an exact match to the material delivered.

You must be present

You must be present at delivery to meet the driver, direct the requested placement and receive the material. Keep your phone available during the confirmed delivery window.

If you are not present, the driver may decline to unload. Contact USA ROCK to discuss next steps. Any cancellation is subject to the Cancellation & Refund Policy.

Placement is the driver’s decision

The driver decides whether the truck can safely enter, maneuver and unload at a requested location, subject to the delivery company’s policies and applicable rules. A request or delivery note does not guarantee placement in a specific spot.

Safe, lawful curbside delivery is generally the simplest option. Driveway, backyard and other placement requests depend on safe access and driver approval. Drivers may refuse or stop an unsafe or prohibited delivery. No one may require a driver to proceed against their safety judgment or company policy.

Tell USA ROCK about access limits before delivery. If the requested placement cannot be approved, contact USA ROCK about a safe alternative or revised arrangements. A driver’s refusal by itself does not establish that you caused the problem, and this policy does not authorize an undisclosed additional fee.

Prepare the delivery area

Provide an accurate address and a clear, accessible unloading area. You must own the property or have authority from its owner to authorize the requested access and unloading. Arrange any required permission for the location, including restrictions on streets, sidewalks, shared access or public property. Identify access restrictions, overhead obstacles, soft ground, slopes or other hazards before delivery.

Locate, mark and protect vulnerable surfaces and underground or concealed features. These include, but are not limited to, concrete, asphalt, pavers, curbs, driveways, lawns, water lines, utility lines, meters, sprinklers, irrigation systems, septic systems and drainage structures. Do not assume a driver can identify concealed features or determine a surface’s load capacity.

Keep people, pets, vehicles and other property clear of the truck and unloading area. Follow the driver’s safety instructions. Delivery does not include spreading, grading or installation unless specifically agreed in writing.

Before unloading, confirm the requested drop location and review the material and load with the driver from a safe position. If something appears wrong, ask the driver to pause and contact USA ROCK. Do not enter the truck’s operating area or climb onto the load. This inspection request does not waive rights that applicable law protects.

Property risks and responsibility

Heavy trucks and bulk unloading can crack or mark surfaces, leave ruts and damage underground or concealed features. By requesting delivery onto your property, you acknowledge these risks and authorize the access and placement you request, subject to driver approval.

You are responsible for the suitability of the access and drop location you provide and for damage caused by your inaccurate directions, undisclosed hazards or failure to prepare and protect the delivery area. To the extent permitted by applicable law, USA ROCK and its partner suppliers and delivery companies do not accept responsibility for damage resulting from those customer-controlled conditions.

Report any delivery problem promptly to usarockproducts@gmail.com, with photographs and your order number where possible. Keep the order confirmation and any written delivery instructions. Reporting a problem does not authorize unsafe unloading or require the driver to return or collect material.

Responsibility for third-party claims you cause

To the extent permitted by applicable law, you agree to reimburse USA ROCK and its independent suppliers and delivery companies for third-party claims and reasonable resulting costs, including reasonable legal expenses, but only in proportion to the loss caused by your proven negligent or intentional wrongful conduct in connection with the delivery. This may include directing access you had no authority to permit or knowingly concealing a material site hazard.

This obligation does not include any portion of a loss caused by the negligence, gross negligence, recklessness, fraud, intentional misconduct or violation of law of USA ROCK or the supplier or delivery company seeking reimbursement. You are not required to assume the defense of claims based on another party’s fault.

State laws and protected rights

Federal law and the mandatory laws applicable to your transaction, including the delivery location’s state law, control over any conflicting policy term. These policies do not release USA ROCK or its partners from liability for their own negligence or intentional misconduct, or waive consumer rights or other liability that cannot lawfully be excluded.

No provision requires you to release, reimburse or indemnify anyone where that obligation is prohibited by applicable law. If a provision cannot lawfully be enforced, it does not apply to that extent; the remaining lawful provisions continue to apply. This section applies to the Delivery Policy and the Cancellation & Refund Policy.
